Terms of service

1. The service

Choice OMG hosts the plan you ordered: Managed WordPress, Measured WordPress, custom application hosting, DNS management, or server-side tagging, as described on the plan's own page. Service starts once you submit the order form and we confirm the migration plan by email, and billing starts the day the site goes live. We may change a plan's included features going forward; Section 8 covers notice.

2. Billing and cancellation

Monthly plans bill in advance each month and end at the close of any month on written notice. Annual plans bill ten months in advance for twelve months of service and are not refunded mid-term. Prices are in Canadian dollars and exclude GST.

3. What we measure and what we do not guarantee

We probe every hosted site every two minutes from five locations, back up nightly to a separate server (daily restore points kept seven days, weekly restore points kept four weeks, a monthly archive kept three months), apply updates weekly and answer support within one business day. We do not offer an uptime percentage or service credits. Restores are performed on request from the most recent good backup and are best-effort until a rehearsed restore time is published on the service page.

4. Acceptable use

You will not host unlawful or infringing content, send unsolicited bulk email or mail spam from our infrastructure, run cryptocurrency mining or other activity that consumes shared resources beyond normal site traffic, or resell hosting capacity without a separate agreement with us. If we find abuse, we will notify you and give you a chance to fix it before suspending the account, except where the abuse actively threatens the security or availability of other customers' sites, in which case we may suspend first and notify you immediately after.

5. Your content and data

You own the content, code and data on your site; we do not claim any right to it beyond what is needed to host and back it up. We hold backups solely to provide the service described in Section 3, not for any other purpose. If your service ends, you can request an export of your site and its backups for thirty days after cancellation; after that window we delete the copies we hold.

6. Measured tier data

Call recordings, form submission logs and analytics collected under the Measured WordPress plan are processed to provide the service: attributing calls and form leads to the marketing that drove them and reporting that back to you. Announcing that a call is recorded, where provincial law requires that announcement, is the customer's responsibility, not ours. Data collected under this section is kept on the schedule described in our privacy policy.

7. Liability

Our total liability to you arising from this agreement is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential damages, including lost profits or lost data, to the extent the law allows us to exclude that liability. This agreement is governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and the parties submit to the exclusive jurisdiction of the courts of Alberta.

8. Changes

We will give you thirty days' notice by email before a price increase or a change that materially reduces what a plan includes. Continued use of the service after a change takes effect means you accept it.
